1. Introduction
This website, falconembroidery.com (“the Site”, “we”, “us”, “our”), is operated by Falcon Embroidery Ltd, a company registered in the United Kingdom under company number 12824255, with its registered office at Lytchett House, 13 Freeland Park., Wareham Road, Poole, England, BH16 6FA. These Terms & Conditions (“Terms”) govern your use of the Site and your purchase of digital embroidery designs from us.
By visiting the Site, creating an account, or placing an order, you agree to be bound by these Terms, together with our Privacy Policy, Refund & Cancellation Policy, and License Terms, which are incorporated by reference. If you do not agree to these Terms, please do not use the Site.
We may update these Terms at any time by posting the revised version on this page. It is your responsibility to check for changes. Continued use of the Site after changes are posted constitutes acceptance of those changes. Any new features or tools added to the Site are also subject to these Terms.
2. Our products
Everything we sell is a digital product: machine embroidery design files delivered electronically as instant downloads. No physical goods are shipped. Designs are supplied in the file formats and sizes described on each product page. It is your responsibility to check that a format is compatible with your embroidery machine and software before purchasing.
We have made every effort to display the colours and images of our designs accurately, but we cannot guarantee that your screen will display colours accurately. Stitched results will vary depending on your machine, thread, stabiliser, and fabric.
3. Using the Site
By using the Site you agree that you will not: use our products or the Site for any unlawful or unauthorised purpose; violate any laws in your jurisdiction (including copyright laws); infringe our intellectual property or that of others; harass, abuse, or harm others; submit false or misleading information; transmit viruses or any malicious code; collect or track others’ personal information; spam, phish, spider, crawl, or scrape the Site; or interfere with or circumvent the Site’s security features. A breach of these Terms may result in immediate termination of your access to our services.
4. Accounts
To purchase and re-download designs you will need an account. You are responsible for keeping your login details confidential and for all activity under your account. You agree to provide accurate, current, and complete information and to keep it up to date so we can process your orders and contact you when needed. We may suspend or close accounts that breach these Terms or are used for fraud or unauthorised file sharing.
5. Orders, pricing, and payment
All prices are shown on the Site and may be displayed in your selected currency. Prices and product descriptions may change at any time without notice; changes do not affect orders already placed. An order is a request to buy; a binding contract is formed when we confirm your order and make the download available to you.
Payment is taken at checkout through our third-party payment providers (such as Stripe, PayPal, and StellarPay). By ordering you confirm that the payment method is yours and that you are authorised to use it. We do not store your full card details.
We reserve the right to refuse or cancel any order, and to limit or prohibit orders that in our judgement appear to be placed by dealers, resellers, or distributors, or that breach these Terms. If we cancel an order you have paid for, we will refund you.
6. Delivery of downloads
Because our products are digital, “delivery” means giving you access to download your files. This normally happens immediately after payment is confirmed, through the order confirmation page, an emailed download link, and your account’s Downloads area. If a download link does not work, contact us and we will make the file available to you.
7. Right to cancel and refunds
Your statutory right to cancel and our refund practice are set out in full in our Refund & Cancellation Policy, which forms part of these Terms. In short: because these are digital products delivered instantly, once you begin downloading a file you agree that your 14-day right to cancel no longer applies to that item. Please read that policy before purchasing.
8. Licence to use designs
Your purchase gives you a lifetime licence to use the designs — you do not own the copyright. What you may and may not do with a design is set out in full in our License Terms. In summary, you may use the designs for personal projects and small-scale commercial use on finished stitched items, but you may not resell, share, or redistribute the design files themselves. Copyright in all designs remains with us or our licensors.
9. Pricing errors, inaccuracies, and omissions
Occasionally information on the Site may contain typographical errors, inaccuracies, or omissions relating to product descriptions, pricing, promotions, or availability. We reserve the right to correct any errors and to change or update information or cancel orders where information is inaccurate, at any time and without prior notice (including after you have submitted an order). We have no obligation to update information except as required by law.
10. User submissions and comments
If you send us ideas, suggestions, reviews, images, or other materials (whether through the Site, email, or social media), you agree that we may use, edit, copy, publish, and distribute them in any medium without restriction, compensation, or obligation of confidentiality. You agree your submissions will not be unlawful, abusive, or obscene, will not infringe any third party’s rights, and will not contain malicious code, and that you will not impersonate anyone or misrepresent the origin of your submission. You are solely responsible for your submissions. We may, but are not obliged to, monitor, edit, or remove content we consider objectionable or in breach of these Terms.
11. Third-party tools and links
We may provide access to third-party tools and links to other websites over which we have no control. These are provided “as is” without warranty or endorsement, and your use of them is at your own risk. We are not responsible for the content or privacy practices of third-party sites; please review their terms and policies.
12. Facebook login — data deletion
If you use Facebook to create or log into your account on falconembroidery.com, you can request permanent deletion of the data we received from Facebook.
- Stop future data sharing: on Facebook, go to Settings & Privacy → Settings → Apps and Websites, find the “Falcon Embroidery – Social Login” app, select it, and click Remove. This stops further data flowing from Facebook to us.
- Delete data we already hold: email [email protected] with the subject “Data Deletion Request for Facebook Login”, including the email address and/or name used for your account, and stating that you want all associated data permanently deleted.
We will process the request and confirm by email once your data has been permanently removed, in line with the timeframes in our Privacy Policy.
13. Disclaimer of warranties
We provide the designs and the Site with reasonable care and skill. To the fullest extent permitted by law, and except as expressly stated by us, the Site and our products are provided “as is” and “as available” without further warranties. We do not guarantee that the Site will be uninterrupted, secure, or error-free, or that files will be compatible with every machine or software. Nothing in these Terms affects your statutory rights as a consumer, including your rights to digital content that matches its description and is of satisfactory quality.
14. Limitation of liability
To the fullest extent permitted by law, Falcon Embroidery and its directors, officers, employees, agents, suppliers, and licensors will not be liable for any indirect, incidental, special, or consequential loss — including lost profits, lost data, or loss arising from your inability to open a file due to incompatible machines or software, or from results that differ from the product images. Nothing in these Terms limits our liability for death or personal injury caused by our negligence, for fraud, or for any liability that cannot be excluded under applicable law. Where liability cannot be excluded but can be limited, our liability is limited to the maximum extent permitted by law.
15. Indemnification
You agree to indemnify and hold harmless Falcon Embroidery and its affiliates, officers, directors, agents, contractors, licensors, service providers, and employees from any claim or demand, including reasonable legal fees, made by any third party arising out of your breach of these Terms or the documents they incorporate, or your violation of any law or the rights of any third party.
16. Severability
If any provision of these Terms is found to be unlawful, void, or unenforceable, that provision will be enforceable to the fullest extent permitted by law, and the unenforceable part will be severed from the remaining provisions, which will continue in full effect.
17. Termination
These Terms remain in effect unless and until terminated by either you or us. You may terminate by ceasing to use the Site and notifying us. If we believe you have failed to comply with these Terms, we may terminate your access at any time without notice, and you will remain liable for all amounts due up to the date of termination. Obligations and liabilities incurred before termination survive termination.
18. Entire agreement
These Terms, together with the policies referenced in them, constitute the entire agreement between you and us and supersede any prior agreements. Our failure to enforce any right or provision is not a waiver of that right or provision. Any ambiguity in these Terms will not be construed against us as the drafting party.
19. Governing law
These Terms are governed by the laws of England and Wales, and are subject to the exclusive jurisdiction of the courts of England and Wales — except where the mandatory consumer laws of your country of residence give you additional rights or a right to bring proceedings locally.
